Photography Terms & Conditions
These Terms & Conditions apply to all photography bookings made with Rhi Thistlethwaite Coaching Pty Ltd (“Photographer”).
By paying an invoice, paying a deposit, or entering into a payment plan, the Client (“you”) confirms they have read, understood, and agreed to these Terms & Conditions.
1. Photography Services
Photography services include:

A scheduled photo shoot at the agreed date and location;

Delivery of the number of edited digital images specified in your invoice via a secure online gallery.
No physical products (e.g. USBs, prints, albums) are included unless expressly stated in your invoice.
2. Payment and Deposit

A non-refundable deposit of 25% of the total package price is required to secure your booking.

The remaining balance is due at least 24 hours before the photo shoot, unless you are on an approved instalment plan.

If paying via instalments (Stripe or GoCardless), up to three (3) payment retries will be attempted. If payment still fails, the booking will be cancelled and all monies paid will be forfeited.
3. Cancellation, Refunds and Store Credit

All monies paid are non-refundable.

If you cancel your photo shoot, any monies paid (excluding the non-refundable deposit) will be held as a store credit, valid for 12 months from the original booking date.

Store credits may be used towards any photography package or coaching service. They are not redeemable for cash, transferable, or resellable.

If you do not rebook and complete a session within the 12 months, your store credit will expire.

You may reschedule once within three (3) months at no cost. Any further reschedules will incur a $250 fee.
4. Client Responsibilities

You are responsible for booking and paying for the chosen location or permits.

If you are late or unprepared, the Photographer is not liable for reduced photographic coverage.

You acknowledge and accept the Photographer’s artistic style, editing approach, and creative decisions.
5. Delivery of Images

Digital images will be delivered within 1–2 weeks via an online gallery.

In the event of illness, injury, or death in the Photographer’s family, delivery may be extended to 6 weeks without compensation.
6. Venue Rules and Behaviour

Some venues impose photography restrictions (e.g. flash, positioning). The Photographer is not liable for missed images due to such rules.

You and your guests must treat the Photographer with respect. Aggressive, abusive, or inappropriate behaviour may result in immediate termination of services, with no refund or credit provided.
7. Copyright and Usage

The Photographer retains full copyright and ownership of all images.

You are granted a non-exclusive, royalty-free, perpetual licence to use the images for personal and business purposes, including marketing and promotions.

You may not sell, resell, or sublicense the images without written consent.
8. Limitation of Liability

The Photographer’s liability is strictly limited to the total amount paid under your booking.

The Photographer is not liable for consequential, indirect, or special losses (e.g. loss of business, income, or opportunities) arising from or related to photography services.

If images are lost, stolen, damaged, or destroyed beyond reasonable control, liability is limited to a refund of monies paid, pro rata to the services not delivered.

If the Photographer is unable to attend due to illness or injury, reasonable efforts will be made to arrange a replacement. If no replacement is available, liability is limited to a refund of monies paid.
9. Force Majeure
The Photographer is not responsible for delays or cancellations due to events beyond reasonable control, including natural disasters, fire, flood, pandemics, war, government restrictions, or industrial disputes.
10. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
Acceptance of Terms
By paying an invoice, deposit, or entering into a payment plan, you agree to these Terms & Conditions in full.
